New York Order to Proceed Without Prepaying Fees/Costs is a court order that allows a party to proceed with a legal action in New York State civil or family court without having to pay any fees or costs in advance. It is commonly known as an "IFP" (In Form Paupers) order. There are two types of New York Order to Proceed Without Prepaying Fees/Costs. The first type, known as "Full IFP," allows the petitioner to proceed with all aspects of the case without paying fees or costs. The second type, known as "Partial IFP," allows the petitioner to proceed with certain aspects of the case without paying fees or costs, while requiring payment for some other aspects of the case. In either case, the petitioner must demonstrate to the court that they are unable to pay the fees or costs associated with the case. Typically, this requires providing evidence of financial hardship, such as pay stubs or tax returns. In addition, the court must determine that the legal action is in good faith and that the petitioner is likely to succeed in court. If these criteria are met, the court will grant the Order to Proceed Without Prepaying Fees/Costs.
