New York Direct Entry Declaration of Impasse (Public Sector) is a process by which the New York State Public Employment Relations Board (PER) can declare a stalemate in negotiations between a public employer and a union representing its employees. This process can be used to resolve collective bargaining disputes when the parties have reached an impasse and are unable to agree on the terms of a collective bargaining agreement. There are two types of Direct Entry Declarations of Impasse, the first being the Single Impasses Direct Entry Declaration of Impasse and the second being the Multiple Impasses Direct Entry Declaration of Impasse. The Single Impasses Direct Entry Declaration of Impasse is used when the parties are deadlocked on one or more issues and need to come to an agreement on those issues. The Multiple Impasses Direct Entry Declaration of Impasse is used when the parties are deadlocked on multiple issues and need to come to an agreement on all the issues. Once the PER declares an impasse, they will appoint a mediator to help the parties reach an agreement. If the parties are still unable to come to an agreement, the PER will declare an emergency impasse and impose a settlement.
