New York Order for alternative service, also known as New York OAS, is a legal process used in New York state which allows for service of process, or the delivery of legal documents such as a summons, complaint, or subpoena, to be done through alternate means other than personal service. This alternative means of service is used when the individual to be served cannot or will not accept service in person. The types of New York Order for alternative service include publication, personal delivery, mail service, email service, fax service, and posting. Publication requires that the documents to be served be published in a newspaper in the county or judicial district where the person to be served resides. Personal delivery requires that the documents to be served be delivered to a person of suitable age and discretion, who may be a family member or acquaintance of the person to be served. Mail service requires that the documents to be served be sent by certified mail with a return receipt requested to the person to be served at their last known address. Email service requires that the documents to be served be emailed to the person to be served at their last known email address. Fax service requires that the documents to be served be faxed to the person to be served at their last known fax number. Posting requires that the documents to be served be posted in an appropriate location, such as the front door of the person to be served's residence or place of business. New York Order for alternative service is used when personal service is not possible, and must be authorized by the court.
