The New York Affidavit to Establish Surviving Tenant By the Entirety is an affidavit used by a surviving tenant in a tenancy by the entirety to establish their right to the deceased tenant's interest in the property. Tenancy by the entirety is a form of ownership in which two people (husband and wife) own a property together. Under this type of ownership, the two tenants share equal ownership and either one may take the full interest of the other upon death. There are two different types of New York Affidavit to Establish Surviving Tenant By the Entirety: 1. Affidavit to Establish Right to Survivorship of Tenancy by the Entirety: This affidavit is used to demonstrate a surviving tenant's right to the deceased tenant's interest in the property. This affidavit is usually filed with the county clerk. 2. Affidavit of Surviving Tenant to Collect the Deceased Tenant’s Interest in Property: This affidavit is used to prove that the surviving tenant is the rightful owner of the deceased tenant's interest in the property. This affidavit is usually submitted to the bank or financial institution that holds the mortgage or deed of trust.
