The New York Procedure for Filing a Civil Notice of Appeal to the 2nd Circuit consists of three types of procedures: 1) Notice of Appeal: A Notice of Appeal must be filed with the Clerk of the 2nd Circuit Court of Appeals within 14 days of the date of entry of the judgment or order from which the appeal is taken. The Notice of Appeal must be accompanied by a Certificate of Interested Persons, a Court-approved form indicating the names of all parties and their respective counsel. 2) Docketing Statement: The Docketing Statement must be filed with the Clerk of the 2nd Circuit Court of Appeals within 14 days of the Notice of Appeal. The Docketing Statement must include a copy of the judgment or order from which the appeal is taken; a description of the issues on appeal; and a list of all parties and their respective counsel. 3) Briefs: The Appellant must file his/her brief with the Clerk of the 2nd Circuit Court of Appeals within 40 days of the Notice of Appeal. The Respondent must file his/her brief within 40 days of the Appellant's brief. The Appellant may file a Reply Brief within 14 days of the Respondent's brief.
