New York Waiver of Notice of Petition For Access To Sealed Adoption Records-Consent (Domestic Relations Law — Section 114) refers to the legal process that enables an adult adopted to gain access to previously sealed adoption records in New York State. This waiver of notice is the consent of the adopted and relinquishing parent(s) to open the adoption file without a court hearing. The New York State Department of Health Adoption Information Registry is responsible for processing the waiver. There are two types of New York Waiver of Notice of Petition For Access To Sealed Adoption Records-Consent (Domestic Relations Law — Section 114): 1) Waiver of Notice by the Adopted, and 2) Waiver of Notice by the Relinquishing Parent(s). The Waiver of Notice by the Adopted requirements the adopted to submit a signed waiver form with a copy of their valid photo identification. The Waiver of Notice by the Relinquishing Parent(s) requires the relinquishing parent(s) to submit a signed waiver form with valid photo identification. Upon receipt of both waivers, the Adoption Information Registry will open the adoption file to the adopted.
