A New York Notice of Appeal (Civil) is a document filed by an appellant, or person appealing a decision, with the appellate court in New York. It is the first step in the appellate process and is a formal notice that the appellant intends to challenge the lower court’s decision. The Notice of Appeal includes the name and contact information of the appellant, the name of the trial court, the case number, and the date of the lower court decision. It also identifies the parties to the appeal and the specific issues that are being appealed. There are two types of New York Notice of Appeal (Civil): a Notice of Appeal from a Supreme Court or County Court judgment, or an Appeal from an Administrative Agency. The Notice of Appeal must be filed in the Appellate Division of the Supreme Court, or the appropriate County Court, within 30 days of the lower court’s decision.
