The Notice of Petition is a notice to the tenant that the landlord is seeking to evict them from the rental unit and that they must appear in court and present their defense. It is important to note that a Notice of Petition does not itself constitute an eviction. The Notice of Petition must include certain information, such as the name and address of the tenant, the length of the lease, the amount of rent due, and the date by which the tenant must answer the petition. The Notice of Petition must also include a copy of the Petition for Nonpayment of Rent, which outlines the landlord’s claims in more detail. There are two types of New York Notice of Petition for Commencing Non-Payment Proceedings: summary proceedings and non-payment proceedings. Summary proceedings are initiated when the tenant has failed to pay rent for two consecutive months or more, while non-payment proceedings are initiated when the tenant has failed to pay rent for only one month.
