New York Divorce, Uncontested, Note of Issue is a document that is filed with the court to start the divorce process. The Note of Issue is not a final judgment, but it does provide the court with an opportunity to review the case and make a decision. There are two types of New York Divorce, Uncontested, Note of Issue: one for a no-fault divorce and one for a fault-based divorce. In a no-fault divorce, both parties agree that the marriage is irretrievably broken and that neither party is at fault for the breakdown of the marriage. In a fault-based divorce, one or both parties must prove that the other party is at fault for the breakdown of the marriage.
