New York ATV Dealer Requirements are the qualifications and regulations for businesses that wish to become an ATV dealer in the state of New York. Requirements vary depending on the type of ATV dealer one wishes to become. There are two primary types of ATV dealers in New York State: (1) Power sports Dealers and (2) Non-Powersports Dealers. Power sports Dealers must obtain a Power sports Dealer License from the New York State Department of Motor Vehicles. This license requires the dealer to have the following: • A valid business address; • A surety bond of at least $20,000; • A sales tax identification number; • A valid Certificate of Authority from the Department of Taxation and Finance; • A license from the Department of Environmental Conservation; and premiseses liability insurance policy. Non-Powersports Dealers must obtain a Motor Vehicle Retail Dealer License from the New York State Department of Motor Vehicles. This license requires the dealer to have the following: • A valid business address; • A surety bond of at least $50,000; • A sales tax identification number; • A valid Certificate of Authority from the Department of Taxation and Finance; • A license from the Department of Environmental Conservation; premiseses liability insurance policy; and • A certificate of compliance from the Department of Motor Vehicles. Both Power sports Dealers and Non-Powersports Dealers are also required to register their business with the New York State Division of Corporations and obtain a Federal Employer Identification Number.
