It is used to prove to the court that someone has been given notice of a lawsuit, summons, or other official court document. There are two main types of New York Affidavits of Service: Personal Service and Substituted Service. Personal Service is when legal documents are delivered personally to an individual, usually by a process server. Substituted Service is when legal documents are delivered to a third party such as a family member or associate of the person being served. Both types of Affidavit of Service must be signed and notarized in order to be accepted by the court.
