New York Form C-A Agency appeal pre-argument statement is an important document required by the New York State Unified Court System for those filing an appeal to the Appellate Division of the Supreme Court from an agency decision. It is a document used to identify the parties to the appeal, describe the agency decision being appealed, identify the issues the appellant wishes to raise, and provide a brief summary of the appellant’s argument. The New York Form C-A Agency appeal pre-argument statement is a mandatory filing required for appeals in the Appellate Division of the Supreme Court. There are two types of New York Form C-A Agency appeal pre-argument statement: (1) Preliminary Statement; and (2) Final Statement. The Preliminary Statement is required to be filed at the same time as the Notice of Appeal, and sets forth the parties to the appeal, the nature of the agency decision being appealed, and a preliminary statement of the issues that the appellant intends to raise in the appeal. The Final Statement is required to be filed within 30 days of filing the Notice of Appeal, and sets forth the parties to the appeal, the nature of the agency decision being appealed, a summary of the appellant’s argument, and a list of documents to be included in the record on appeal.
