Oklahoma Measure of Damages: Substantial Performance is a measure of damages that applies when a party substantially, but not entirely, performs on a contract. This measure of damages is used when a party has not fully performed on a contract, yet has completed a majority of the contractual obligations. It is used to assess the amount of damages to which the non-breaching party is entitled. The calculation of damages under this measure considers the value of the services performed in comparison to the amount of the contract, as well as any additional costs incurred by the non-breaching party as a result of the breach. There are three types of Oklahoma Measure of Damages: Substantial Performance: Compensatory Damages, Restitution Damages, and Quantum Merit Damages. Compensatory Damages are calculated by subtracting the value of the services performed from the full value of the contract. Restitution Damages are calculated based on the amount of money spent by the non-breaching party to complete the contract. Quantum Merit Damages are calculated based on the reasonable value of the services performed.
