Oklahoma LOANED EMPLOYEE --- DETERMINATION is a process used by the Oklahoma Department of Labor to determine whether a person is an employee or an independent contractor. The process requires employers to provide documentation to the Department of Labor regarding the individual's work duties, the amount and type of compensation, the duration of the arrangement, and the individual's degree of control over the work. The Department of Labor will then review the documentation and make a determination whether the individual is an employee or an independent contractor. There are two types of Oklahoma LOANED EMPLOYEE --- DETERMINATION: 1. The Common Law Test — This test looks at the amount of control an employer has over the individual's work, the duration of the arrangement, the amount of compensation paid, and the relationship between the parties. 2. The Economic Realities Test — This test looks at the individual's economic dependence on the employer, the individual's skills and experience, the extent of the employer's control over the individual's work, and the degree to which the individual's services are integral to the employer's business.
