Oklahoma Negligence Per Se- Violation of Statute or Ordinance is a legal doctrine that holds a defendant liable for a breach of a duty to act in a certain way as required by a statute or ordinance. This doctrine applies when a defendant fails to act in accordance with a statute or ordinance in a way that results in injury to another person. The violation of the statute or ordinance must be the proximate cause of the injury in order for a negligence per se claim to be successful. There are two types of Oklahoma Negligence Per Se- Violation of Statute or Ordinance: (1) statutory violations, which involve violations of statutory provisions; and (2) ordinance violations, which involve violations of local ordinances. In either case, the plaintiff must show that the defendant had a duty to act in a certain way as required by the applicable statute or ordinance, that the defendant failed to meet that duty, and that the defendant's failure was the proximate cause of the plaintiff's injury.
