Oklahoma Final Order; Exhaustion of State Remedies is a process used to determine the validity of a claim or action against a state agency. It is a way to make sure that the state has exhausted all available remedies before a court has the authority to make a ruling. There are three types of Oklahoma Final Orders; Exhaustion of State Remedies: administrative exhaustion, judicial exhaustion, and legislative exhaustion. Administrative exhaustion requires claimants to exhaust all administrative remedies before filing a suit in court. Judicial exhaustion requires claimants to go through the court system to resolve the claim. Finally, legislative exhaustion requires claimants to bring their claim before the legislative bodies of the state in order to receive a ruling. All three of these types of Oklahoma Final Orders; Exhaustion of State Remedies must be used in order for a claimant to receive a ruling on their claim.
