Oregon Trial By Affidavit (TBA) is a civil lawsuit procedure available in the state of Oregon. It is an alternative to the traditional trial process and provides an expedited resolution to certain civil disputes. TBA allows parties to present their cases to a judge in writing, without having to appear in court or have a trial. There are two types of Oregon Trial By Affidavit: (1) Standard TBA and (2) Summary TBA. Standard TBA is available for disputes up to $50,000 and requires both parties to submit evidence such as affidavits, witness testimony, and other documents. Summary TBA is available for disputes up to $10,000 and requires only one party to submit evidence. Both types of TBA require the parties to submit a statement of facts related to the dispute. The judge then reviews the statements and evidence and makes a decision based on the evidence.
