The Pennsylvania Notice of Beneficial Interest (PBI) is a legal document required by the Pennsylvania Department of Banking and Securities (PA DBS) to disclose a beneficial interest in a Pennsylvania real estate transfer. The law requires that this document be filed with the PA DBS prior to the transfer of any real estate located within the state of Pennsylvania. The purpose of the PBI is to provide the PA DBS with information about the beneficial interest being transferred, including the name of the beneficial owner, the address of the property, and the amount of the beneficial interest. There are three types of Pennsylvania Notice of Beneficial Interest: (1) Notice of Beneficial Interest for Transfers of Real Property; (2) Notice of Beneficial Interest for Private Transfers of Real Property; and (3) Notice of Beneficial Interest for Transfers of Real Property Pursuant to a Will. The type of notice required depends on the type of transfer being made. For transfers of real property, the Notice of Beneficial Interest must be signed by the transferor and transferee and must include the name and address of the beneficial owner, the address of the real estate, and the amount of the beneficial interest. For private transfers of real property, the Notice of Beneficial Interest must include the name and address of the beneficial owner, the address of the real estate, and a statement that the transaction is a private transfer. For transfers of real property pursuant to a will, the Notice of Beneficial Interest must include the name and address of the beneficial owner, the address of the real estate, and a statement that the transfer is being made pursuant to the terms of a will.
