The Pennsylvania Unavailable Witness Affidavit-Oath of Non-Subscribing Witness is a document used when a witness is not available to sign an affidavit in person. The affidavit is sworn by a non-subscribing witness, who is someone other than the witness who is signing the affidavit. The affidavit must be sworn before a Notary Public or other authorized official, and must include the following information: the name, address, and signature of the non-subscribing witness; the name of the unavailable witness; the reason why the witness is unavailable; a statement that the non-subscribing witness believes the unavailable witness to be of legal age and competent to testify; and a statement that the non-subscribing witness has read the affidavit and believes the contents to be true. There are two types of Pennsylvania Unavailable Witness Affidavit-Oath of Non-Subscribing Witness: a General Affidavit and a Supporting Affidavit. The General Affidavit is used when the witness is not available to sign the affidavit, and the Supporting Affidavit is used when the witness is available but unable to sign due to physical or mental disability. Both types of affidavits must be notarized in order to be considered valid.
