The Pennsylvania Unavailable Witness Affidavit is a document that is used in Pennsylvania court proceedings when a witness cannot appear in court to testify. The document is also known as an Unworn Declaration, or an Affidavit of Unavailability, and it is used to provide evidence in the court without the witness being present. The affidavit is sworn under penalty of perjury and must be signed by the affine or the affine’s attorney. There are two types of Pennsylvania Unavailable Witness Affidavit: the hearsay affidavit and the witness affidavit. The hearsay affidavit is used when the witness is unavailable to testify and the affine must testify about the witness’s statements. The witness affidavit is used when the affine has direct knowledge of the facts and is able to testify about them in court. The Pennsylvania Unavailable Witness Affidavit must be notarized and must include the affine’s name, address, and contact information; a description of the witness’s unavailability; and a statement affirming the truthfulness of the affidavit. The affidavit must also include a description of the incident or facts that the witness would have testified to in court, and the attestation of the affine.
