The Pennsylvania Waiver of Counsel is a legal document that allows a person to waive their right to counsel in criminal proceedings in the state of Pennsylvania. It is a formal declaration made by the defendant, in the presence of the court and a qualified attorney, that they wish to represent themselves in their criminal proceedings. In Pennsylvania, there are two types of Waiver of Counsel: Voluntary Waiver of Counsel and Involuntary Waiver of Counsel. Voluntary Waiver of Counsel is when the defendant, of their own volition, waives their right to counsel and decides to represent themselves. Involuntary Waiver of Counsel is when the defendant is deemed to be incapable of representing themselves due to mental incapacity, and the court appoints an attorney to represent them. In either case, the defendant must sign the Waiver of Counsel form and have it witnessed by an attorney in order for it to be valid.
