A Pennsylvania Notice of Appeal (Agency) is a document that must be filed with the Pennsylvania Commonwealth Court in order to initiate an appeal from an administrative agency decision. Agency appeals are a type of civil action in which the appellant is challenging a final decision or order of an administrative agency, such as the Department of Environmental Protection or Department of Labor and Industry. There are two types of Pennsylvania Notice of Appeal (Agency): 1) an original notice of appeal, which is filed when the appellant is seeking direct review of an administrative agency decision, and 2) a notice of cross-appeal, which is filed when the respondent has already filed an appeal and the appellant is now seeking to cross-appeal. Both types of Pennsylvania Notice of Appeal (Agency) must be filed within 30 days of the administrative agency’s decision in order to preserve the appellant’s right to appeal.
