The Pennsylvania Agreement for Compensation for Death (PA-DCD) is a state-mandated program that provides financial benefits to eligible survivors of workers who were fatally injured while performing work-related duties in Pennsylvania. The program is funded through employer contributions collected by the Pennsylvania Department of Labor and Industry. Benefits are administered by the State Workers’ Insurance Fund. The PA-DCD provides death benefits to eligible survivors of deceased workers. Benefits are available to both dependents and non-dependents of the deceased and are based on the deceased’s average weekly wage (AWW). The maximum weekly benefit is the least of the deceased’s AWW or the state-mandated maximum benefit rate. Benefits are calculated using the following formula: AWW x 2/3 x (Number of Dependents + 1) = Weekly Benefit The PA-DCD program includes two types of benefits: funeral benefits and death benefits. Funeral benefits are payable to the funeral home or other designated payee, up to a maximum of $3,000, to assist with funeral and burial expenses. Death benefits are payable to the eligible survivors and are based on the deceased’s AWW. Benefits may be paid up to a maximum of 500 weeks, depending on the number of dependents. Eligible survivors may also receive a lump sum payment upon the death of the worker.
