The South Carolina Maritime Drug Law Enforcement Act is a state law that provides criminal penalties for the possession, sale, manufacture, and trafficking of illegal drugs on South Carolina waterways. The Act also makes it illegal to possess any drug paraphernalia used in the commission of a drug-related offense. The Act also gives the South Carolina Department of Natural Resources authority to search and seize vessels suspected of drug-related activity. The Act includes two distinct sections: the South Carolina Maritime Drug Interdiction Act and the South Carolina Maritime Drug Trafficking Act. The South Carolina Maritime Drug Interdiction Act provides for the arrest and prosecution of persons found to be in possession of drugs or drug paraphernalia while on board a vessel in South Carolina waters. The Act also allows for the search of vessels suspected of drug-related activity, and provides for the forfeiture of vessels and their cargo if drugs are found on board. The South Carolina Maritime Drug Trafficking Act provides for the arrest and prosecution of persons found to be engaged in drug trafficking activity on vessels in South Carolina waters. Under the Act, vessels found to be used in the drug trafficking activity can be seized and forfeited. The Act also provides for the forfeiture of all proceeds and profits derived from drug-related activities.
