South Carolina Transfer of Jurisdiction is a legal process that allows the transfer of criminal and civil jurisdiction from the state court system to the tribal court system in South Carolina. The transfer of jurisdiction is authorized by the South Carolina General Assembly and is granted by a court order issued by the South Carolina Supreme Court. There are two types of South Carolina Transfer of Jurisdiction: voluntary and involuntary transfers. A voluntary transfer of jurisdiction occurs when the tribal court and state court agree to transfer jurisdiction over a particular case or cases. An involuntary transfer of jurisdiction occurs when one court system is unable to adequately handle a case and the other court system is better suited to handle it.
