A South Carolina Petition for Removal of Personal Representative is a legal document used to request the removal of a Personal Representative from an estate. A Personal Representative is any individual appointed by a court to manage the estate of a deceased person. There are two types of South Carolina Petition for Removal of Personal Representative: 1) Removal for Improper Performance and 2) Removal for Conflict of Interest. The Removal for Improper Performance Petition is used to request the removal of a Personal Representative who has failed to properly fulfill their duties, such as failing to file required documents, failing to pay debts, or failing to properly manage the estate. The Removal for Conflict of Interest Petition is used to request the removal of a Personal Representative who has a conflict of interest with the estate, such as if the Personal Representative is a creditor of the estate or is a beneficiary of the estate. In either case, the Petition must be served to the Personal Representative and the court in order to be considered. Once the Petition has been filed, a hearing will be held where the Petitioner will need to present evidence to support their request for removal. The court will then decide whether to remove the Personal Representative.
