A South Carolina Exempt Property Claim is a claim that is made by an individual to exempt certain property from a bankruptcy estate. The purpose of such a claim is to ensure that the assets in question are not seized by creditors during a bankruptcy proceeding. There are four different types of South Carolina Exempt Property Claims: Homestead Exemption Claim, Personal Property Exemption Claim, Motor Vehicle Exemption Claim, and Wildcard Exemption Claim. The Homestead Exemption Claim allows an individual to exempt up to $50,000 in equity from their primary residence from bankruptcy proceedings. The Personal Property Exemption Claim allows an individual to exempt up to $2,400 of personal property, such as furniture, clothes, and art. The Motor Vehicle Exemption Claim allows an individual to exempt up to $3,500 of equity in a motor vehicle from bankruptcy proceedings. Lastly, the Wildcard Exemption Claim allows an individual to exempt up to $1,250 of any type of property from bankruptcy proceedings. In order to make a South Carolina Exempt Property Claim, an individual must fill out the appropriate forms and submit them to the bankruptcy court. Certain requirements must be met for each type of claim in order for it to be accepted by the court.
