A South Carolina Affidavit and Complaint (Claim & Delivery) is a legal document used in the state of South Carolina to begin a lawsuit in which the plaintiff (the person filing the complaint) is seeking the return of property that has been wrongfully taken or withheld from them. This type of complaint is often used when a debtor has failed to deliver property that has been sold or leased, or when a creditor has taken possession of a debtor’s property without permission. The South Carolina Affidavit and Complaint (Claim & Delivery) must be filed with the court and a copy must be served on the defendant (the person charged with wrongfully taking or withholding the property). The defendant then has a certain amount of time to reply to the complaint or face a default judgment. There are two types of South Carolina Affidavit and Complaint (Claim & Delivery): a single claim and a multiple claim. A single claim is when a plaintiff files a single complaint against a single defendant, while a multiple claim is when a plaintiff files a complaint against multiple defendants.
