A South Carolina Complaint (Decrease Child Support) is a legal document filed with the family court by a custodial parent or guardian in order to request a decrease in the amount of child support being paid. The complaint is typically used when the current amount of child support is no longer deemed necessary or appropriate due to a change in the family’s financial circumstances. The complaint must be filed with the family court in the county where the custodial parent or guardian resides. In South Carolina, there are two types of Complaint (Decrease Child Support): 1. Agreement-based Complaint (Decrease Child Support): This type of Complaint is filed when both the custodial parent/guardian and the non-custodial parent/guardian agree to the decrease in child support. 2. Court-ordered Complaint (Decrease Child Support): This type of Complaint is filed when the custodial parent/guardian is requesting a decrease in child support without the agreement of the non-custodial parent/guardian. In this case, the court may order a decrease in child support after a hearing.
