A South Carolina Order for Mental Health Evaluation (SOME) is an order issued by a judge or magistrate that directs an individual to be evaluated by a mental health professional for the purpose of determining their mental fitness and/or their competency to stand trial. This order is valid throughout the state of South Carolina. There are two types of SOME: an emergency evaluation order and a regular evaluation order. An emergency evaluation order is issued when an individual is deemed to pose an immediate threat to themselves or others. This order requires an individual to be evaluated within 24 hours of the issuance of the order and for the evaluation to be completed within 72 hours. A regular evaluation order is issued when an individual is not deemed to pose an immediate threat to themselves or others. This order requires an individual to be evaluated within seven days of the issuance of the order and for the evaluation to be completed within 14 days. In both cases, the mental health professional that performs the evaluation must provide a written report to the court within the specified timeframe. The evaluation report must include an assessment of the individual’s mental fitness and/or competency to stand trial. The report may also include recommendations for the individual’s treatment or other actions to be taken by the court.
