A South Dakota Writ of Execution Form is a legal document used by a court to order the sheriff to collect on a judgment. This form is used by a judgment creditor to collect a money judgment from a judgment debtor. It authorizes the sheriff to seize and sell the debtor’s personal property and assets to satisfy the judgment debt. There are two types of South Dakota Writ of Execution Form: (1) the Writ of Execution for Sale of Personal Property and (2) the Writ of Execution for Seizure of Real Property. The Writ of Execution for Sale of Personal Property authorizes the sheriff to seize personal property that is owned by the debtor and then to sell the property at a public sale, with the proceeds going to the judgment creditor. The Writ of Execution for Seizure of Real Property authorizes the sheriff to seize real property owned by the debtor, such as land, buildings, and other immovable properties, and to sell them at a public sale, with the proceeds going to the judgment creditor.
