A South Dakota Domestic Permanent Order of Protection is a civil court order issued to protect victims of domestic abuse, stalking, and/or harassment. It is designed to protect victims from further harm, provide safety, and prevent contact between the abuser and the victim. The order may include provisions such as restraining the abuser from coming within a certain distance of the victim, prohibitions against harassing or contacting the victim, and/or prohibiting the abuser from entering the victim’s home or place of employment. There are two types of South Dakota Domestic Permanent Orders of Protection: Domestic Abuse Protection Orders (Capos) and Domestic Harassment Protection Orders (Hippos). Both orders are issued by a judge and are legally binding. Once issued, the abuser must comply with the order or face criminal penalties.
