A South Dakota Continuance of Temporary Protection Order Hearing is a court hearing for victims of domestic violence, sexual assault, stalking, harassment, or other forms of abuse to extend the duration of their existing temporary protection order. During the hearing, the petitioner (victim) must present evidence to the court to support their request for an extension of protection. The respondent (alleged abuser) is also given an opportunity to present evidence and cross-examine the petitioner. The court then makes a determination based on the evidence and testimony presented. There are two types of South Dakota Continuance of Temporary Protection Order Hearings: Ex Parte and Non-Ex Part. An Ex Parte Hearing is held without the respondent present and is usually granted after the petitioner has provided evidence of abuse to the court. A Non-Ex Part Hearing is held with both parties present and is typically used when the respondent contests the extension request.
