Tennessee Consents to Exercise Magistrate Judge Jurisdiction (AO 85 form)- Where a District Judge has been assigned as Presiding Judge is a form used in the United States District Court for the Middle District of Tennessee. This form is used when a District Judge has been assigned to preside over a civil or criminal case and both parties involved are willing to have a Magistrate Judge exercises the jurisdiction of the District Judge. The AO 85 form has two types, depending on the circumstances of the case. The first type is the “Consent to Exercise Jurisdiction By the Magistrate Judge” and the second type is the “Consent to Exercise Jurisdiction By the District Judge”. In the first type, both parties to the case must sign the form in order to consent to having a Magistrate Judge exercises the jurisdiction of the District Judge. The form also requires an acknowledgement that the parties understand their right to have a District Judge decides the case and that they are voluntarily consenting to the jurisdiction of the Magistrate Judge. In the second type, the form requires the signature of both parties, and the District Judge must also sign the form in order to consent to having the Magistrate Judge exercises the jurisdiction of the District Judge. This form is used to ensure that both parties understand their rights and are voluntarily consenting to the jurisdiction of the Magistrate Judge.
