The Tennessee Commission to take Deposition is a Court order issued by a Clerk of the Circuit Court or Chancery Court authorizing a Commissioner to take deposition testimony in a civil case. The Commissioner is a neutral third-party appointed by the Court to administer the deposition and to ensure that both parties are treated fairly. The Commissioner has the authority to set the schedule for the deposition, swear in witnesses, administer oaths, and ensure that the deposition is conducted in accordance with the rules of civil procedure. There are two types of Tennessee Commission to take Deposition: a Limited Commission and an Unlimited Commission. A Limited Commission authorizes the Commissioner to take deposition testimony in a specific county or area. An Unlimited Commission authorizes the Commissioner to take deposition testimony anywhere in the State of Tennessee.
