Tennessee Proceeding to Enforce Foreign Judgment is a legal process that allows Tennessee residents to obtain a judgment in Tennessee for a debt that was incurred in a foreign country. In this process, the judgment creditor (the person owed the debt) must prove that the foreign judgment is valid and enforceable in Tennessee. The judgment creditor must also prove that the debtor (the person owing the debt) is subject to the jurisdiction of Tennessee courts. Once the court has determined that the foreign judgment is valid and enforceable, the court will enter a judgment in Tennessee for the same amount as the foreign judgment. There are two types of Tennessee Proceeding to Enforce Foreign Judgment. The first type is a direct action, which is a new lawsuit in Tennessee to enforce the foreign judgment. The second type is ancillary action, which is a legal procedure to register the foreign judgment in Tennessee.
