Tennessee ORDER — for Service by Publication is a document that is used by a court when an individual cannot be located or personally served with legal documents. It can be used when a plaintiff is uncertain of the whereabouts of the defendant or when the defendant has gone into hiding. It is a formal request from a court to a newspaper or other publication to publish notice of the pending court action in an effort to locate the defendant. There are two types of Tennessee ORDER — for Service by Publication: Ten Day Notice and Fourteen Day Notice. The Ten Day Notice is filed when the last known residence of the defendant is within the state of Tennessee. The Fourteen-Day Notice is filed when the defendant's last known residence is outside the state of Tennessee. The service by publication requests that the notice be published for a certain number of days in order for the defendant to be officially served with the legal documents.
