Tennessee Consent Order of Driving Probation (CODE) is a legal agreement between the state of Tennessee and a driver charged with a moving violation. It is sometimes referred to as a plea bargain and is often used to reduce the severity of a potential penalty for the driver. Under a CODE, the driver agrees to a number of conditions stipulated by the court in exchange for a reduced penalty. These conditions may include, but are not limited to, attending a driver safety course, providing proof of insurance, or completing a period of probationary driving. There are two types of Tennessee Consent Order of Driving Probation: Deferred Sentencing and Deferred Disposition. Deferred Sentencing is a type of CODE in which the driver's sentence is suspended and the driver is placed on probation for a period of time, usually 6 months. During this time, the driver must follow all court-mandated conditions or risk having the sentence reinstated. Deferred Disposition is a type of CODE in which the driver's sentence is held in abeyance and the charges are dismissed upon successful completion of the court-mandated conditions.
