A Tennessee Affidavit of Complaint (Criminal) is a sworn statement submitted to the court to initiate a criminal prosecution. It is used to initiate criminal proceedings in the state of Tennessee. The affidavit of complaint is completed by a law enforcement officer, or other individual, who has knowledge of the crime and is able to testify to the facts of the case. This document outlines the offense and the evidence supporting the allegation. There are two types of Tennessee Affidavit of Complaint (Criminal): the Felony Complaint and the Misdemeanor Complaint. The Felony Complaint is used for more serious offenses, such as murder, rape, and robbery. The Misdemeanor Complaint is used for less serious offenses, such as traffic violations, disorderly conduct, and possession of a controlled substance. The Affidavit of Complaint must include personal identification of the accused, the date and location of the offense, a description of the offense, the identity of the victim, and the signature of the person making the complaint. It must also include an affidavit of probable cause, which is a sworn statement that outlines the facts of the case that justify the filing of charges. Once the Affidavit of Complaint is filed, a warrant for the arrest of the accused will be issued.
