The Tennessee Petition for Benefits Determination is a legal document used to appeal or contest a decision by the Tennessee Department of Human Services (DHS) regarding a person’s eligibility for certain public benefits. This includes disputes over decisions made by DHS regarding eligibility for financial assistance, food stamps, and Medicaid. The petition must be submitted to the DHS Office of Administrative Hearings within 30 days of the date the person received the decision from DHS. There are two types of Tennessee Petition for Benefits Determination: an Administrative Review and an Appeal. An Administrative Review is used to challenge a decision made by DHS about financial assistance, food stamps, or Medicaid. An Appeal is used to challenge a decision by DHS about denying a request for a hearing or reconsideration.
