Description Sample Notice Letter To Tenant To Move Out

This form is for use by a Tenant to terminate a month-to-month residential lease. "Residential" includes a house, apartment or condo. Unless a written agreement provides otherwise, the Tenant does not have to have a reason for terminating the Lease in this manner, other than a desire to end the lease. A month-to-month lease is one which continues from month-to-month unless either party chooses to terminate. Unless a written agreement provides for a longer notice, 30 days notice is required prior to termination in this state. The notice must be given to the Landlord within at least 30 days prior to the termination date. The form indicates that the Tenant has chosen to terminate the lease, and states the deadline date the Tenant will vacate the premises. For additional information, see the Law Summary link.

In Texas, landlords must give tenants 30 days' notice before terminating the lease.Often, month-to-month leases are verbal, so the terms can seem murky. But Texas law is clearboth landlords and tenants can end their agreement at any time, as long as they give the other person 30 days' advance notice.

For a month-to-month tenancy, you must give your tenant a thirty days' notice to vacate the premises. Basically, the notice tells the tenant that they have exactly thirty days to move out. For a fixed-term tenancy, you must wait until the existing lease term comes to an end.

Once the notice is mailed or delivered, your tenancy will terminate 30 days after the date that rent is next due, even if that date is several months before your lease expires.

In most cases, you give the landlord/agent a written termination notice and vacate ('give vacant posession') move out and return the keys according to your notice. You can vacate before the date in your termination notice but keep paying rent until the end of the notice period.
