A Texas Statement for a Compensation Claim in Excess of the Statutory Case Compensation Maximum (District Court) is a written statement submitted to the court by a party in a civil action claiming that the amount of compensation that they are entitled to receive is more than the maximum compensation set by statute for their case. The statement must include a detailed description of the party’s claim, including the amount of damages they are seeking and the reasons why they believe they are entitled to receive the additional compensation. The statement must also include a description of any evidence, documentation, or other information that the party is presenting in support of their claim. There are two types of Texas Statement for a Compensation Claim in Excess of the Statutory Case Compensation Maximum (District Court): a motion for summary judgment and a motion for additional compensation. The motion for summary judgment is used when the party’s claim is based on undisputed facts and the party seeks additional compensation on the basis that the maximum compensation set by statute is inadequate to meet their needs. The motion for additional compensation is used when the party is seeking additional compensation that is not covered by the statute, such as punitive damages or attorney’s fees.
