Texas Application for a Search Warrant is a sworn statement by a law enforcement officer that outlines the facts and circumstances that give a judge probable cause to believe that a crime was committed and/or that evidence of a crime is located in a certain place. It must be signed by the officer applying for the warrant and include details such as the location, description of property to be searched, and a description of the criminal activity that is believed to have occurred. There are two types of Texas Application for a Search Warrant: a magistrate warrant and a warrant by affidavit. A magistrate warrant is issued by a judge or magistrate based on sworn testimony from a law enforcement officer. A warrant by affidavit is based on a sworn statement from a non-law enforcement witness or other source of information. Both types of warrant must include the same information and be based on probable cause.
