An Offer to Purchase Land Prior to Condemnation (OPP LC) is a contract between a buyer and seller for the purchase of property prior to the commencement of formal condemnation proceedings. The buyer makes an offer to purchase the property at a certain price and the seller agrees to the offer or makes a counteroffer. The buyer can also make provisions in the offer to include additional items (such as buildings, rights of way, easements, etc.), which may be necessary for the buyer’s proposed use of the property. The seller may accept or reject the offer, or make a counteroffer. If accepted, the offer becomes a binding contract. There are two types of Offer to Purchase Land Prior to Condemnation: 1. Voluntary Offer to Purchase Land Prior to Condemnation: This type of OPP LC is entered into by the buyer and seller voluntarily. It is not legally binding until it is accepted by both parties. 2. Condemnation Offer to Purchase Land Prior to Condemnation: This type of OPP LC is made by a governmental authority and is legally binding. The offer must be accepted by the seller before the condemnation proceedings can begin.
