A Landlord Consent and Estoppel Agreement is a legal document used by landlords to provide written consent to a tenant for a particular action or to protect their interests in a rental agreement. This type of agreement typically includes a landlord's consent to the tenant's assignment or transfer of the lease to another party, the tenant's assumption of the lease, or the tenant's alteration of the leased premises. It also outlines the tenant's representations and warranties of the rental agreement. The Estoppel Agreement serves as a written confirmation of the landlord's agreement to the tenant's request. There are two types of Landlord Consent and Estoppel Agreement: 1) the Assignment and Subletting Agreement, and 2) the Alteration Agreement. In an Assignment and Subletting Agreement, the tenant is granted permission to assign or sublet the rental agreement to another party. An Alteration Agreement grants the tenant permission to make changes or alterations to the leased premises. Both types of agreements must be signed by the landlord and the tenant in order to be legally binding.
