1.05 Explanatory: Bench Conferences and Recesses are proceedings that occur during a trial in which the judge and attorneys discuss matters away from the jury's presence. This is done to ensure that the jury is not exposed to information that could be prejudicial to the case. There are two types of Bench Conferences and Recesses: Bench Conferences and Recesses. Bench Conferences occur when the judge and attorneys need to discuss matters in private. These conferences typically occur at the request of one or both parties, and focus on legal issues, evidence, or procedural matters. During a Bench Conference, the jury is typically asked to leave the courtroom for the duration. Recesses are breaks taken during the trial, typically to allow all parties to review evidence, discuss the case, or otherwise prepare for the next phase of the trial. During a Recess, the jury is also typically asked to leave the courtroom.
