8.42 ELEMENTS OF CLAIM: HARASSMENT (By Nonsupervisor) is a form of unlawful discrimination and refers to any unwelcome conduct based on a protected characteristic, such as race, color, religion, sex, national origin, age, disability, or genetic information, that creates an intimidating, hostile, or offensive work environment.
