Final Lien Waiver & Affidavit of Payment is a legal document that is used in construction transactions to release a lien on a property once payment has been received. It is a legally binding document that acknowledges that payment has been made and that a lien is being released. There are two main types of Final Lien Waiver & Affidavit of Payment. The first is a full lien waiver, which is a document signed by the lien claimant, such as a contractor, subcontractor, or supplier, and witnessed by the lie nor, such as the property owner, that states that the lie nor has received full payment and is releasing the lien on the property. The second is a partial lien waiver, which is a document signed by the lien claimant and witnessed by the lie nor that states that the lie nor has received partial payment and is releasing the lien on the property. It also includes a statement of the remaining amount of the lien that is still owed to the lie nor. Both types of Final Lien Waiver & Affidavit of Payment must be signed, notarized, and filed with the appropriate court or registry to be legally binding.
