An Application for Leave to File a Second or Successive Motion to Vacate, Set Aside or Correct Sentence 28 U.S.C. Sec. 2255 (“2255 Motion”) is a petition filed with a federal court of appeals by a prisoner who has already been denied relief under 28 U.S.C. § 2255. This motion seeks permission to file a second or successive motion under § 2255. The application must include a description of the new evidence or legal argument that the prisoner believes would demonstrate a violation of the prisoner's constitutional rights that occurred after the initial motion was denied. The application must also explain why the petitioner is unable to bring the claims in the initial motion.
