A Petition for Review of Order of Agency, Board, Commission or Officer, also known as a Petition for Judicial Review, is a legal document used to appeal a decision made by an administrative agency, board, commission, or officer. This petition requests that a court review the decision and determine whether it was valid based on the evidence presented. The petitioner can also request that the court issue an order to modify, reverse, or set aside the decision. There are two main types of Petition for Review of Order of Agency, Board, Commission or Officer: Original and Appellate. An Original Petition is filed in the trial court where the administrative agency decision was made, while an Appellate Petition is filed with an appellate court. The petitioner must include certain information in their Petition for Review of Order of Agency, Board, Commission or Officer, including a copy of the administrative decision, a brief explanation of why the petitioner disagrees with the decision, and any relevant evidence to support their case. The petitioner must also include a certificate of service that proves that the other parties involved in the administrative decision were given notice of the petition.
